贏218票，不敵5票幽靈人口，村長當選無效？嘉義縣民雄鄉西昌村長張永和，去年選村長贏對手218票，但法官認定有5票幽靈人口，即構成當選無效之理由，依違反選罷法判他當選效。張永和表示，不公平，要上訴。2014嘉義縣五合一選舉，民雄鄉西昌村第20屆村長選舉，張永和、吳銘塘競選激烈，最後張永和獲480票，吳銘塘獲262票，張以218票遙遙領先吳而當選村長，但吳指控張涉嫌遷入10餘名幽靈人口、賄選，並對張提出當選無效之訴。

法官審理，張永和在選前向農會貸款數百萬元，是為購買農用機具，涉嫌賄選證據不足，但張永和的戶籍內於去年4、5月間，有張姓、賴姓、李姓等5人遷入，並於11月29日完成投票，張、賴2人隨即於12月15日遷出戶籍，足認5人為使張當選村長而虛偽遷移戶口，即俗稱的「幽靈人口」。張永和抗辯表示，5人是他的親戚，回來幫忙農事而遷入戶口，且他贏對手吳銘塘218票，設若真有10餘名幽靈人口，也不足以影響選舉結果。法官指出，依違反選罷法第120條第1項規定，有刑法第146條第2項妨害選舉投票結果正確行為之當選無效事由，並不以有影響投選舉結果為必要，換言之，5票雖不足以影響選舉結果，但有幽靈人口的行為，就足以構成當選無效的理由，因此，判決張永和當選無效。(中國時報)，
